2. How these terms apply

The website provisions apply to your use of our website. The business services and equipment hire provisions apply to business bookings where we provide these terms to you before the contract is made and they form part of the agreed contract. Browsing this website does not create a booking or equipment hire agreement.

Our business booking provisions are intended for clients acting in the course of their business, trade or profession. If you are booking as a consumer, we will provide appropriate terms before you book. Nothing in these terms removes any statutory rights you may have as a consumer.

Any project specific terms expressly agreed in writing take priority over these general terms where they conflict. References to writing include email.

3. Using our website

You may use this website for lawful purposes, including learning about our work and making enquiries.

You must not misuse the website, attempt to gain unauthorised access, introduce harmful software, interfere with its operation or use its content for unlawful purposes.

4. Website information and our services

We take reasonable care to keep website information accurate and current. However, website descriptions, photographs and examples illustrate our work and do not guarantee that particular equipment, personnel or services will be available for your project.

The scope, specification, price and delivery arrangements for each project will be confirmed separately in writing. Website information is general information and should not be relied on as project specific technical or safety advice.

5. Enquiries, quotations and bookings

Submitting an enquiry does not confirm a booking. A booking becomes binding when we confirm our acceptance in writing following agreement of the quotation and applicable terms.

Quotations are valid for the period stated and are subject to equipment and personnel availability until the booking is confirmed. VAT and any additional charges will be identified in the quotation.

The person placing a booking must have authority to enter into the agreement on behalf of the client.

6. Scope and changes

We will supply the services and equipment described in the accepted quotation or written project specification, using reasonable care and skill.

Changes to dates, venues, equipment, design, crew requirements or working hours must be agreed in writing. We will explain any resulting changes to price, availability or delivery before carrying out the additional work, except where immediate action is reasonably necessary for safety.

We may use suitably qualified freelancers and specialist suppliers to deliver the agreed services. We remain responsible for our contractual obligations.

7. Payment

Deposits, payment stages and invoice due dates will be stated in the quotation or booking confirmation. Any deposit will be credited against the agreed charges.

If payment is overdue, we may give written notice requiring payment and, if it remains unpaid after a reasonable period stated in that notice, suspend further work or equipment supply. Any suspension will be managed safely.

We reserve any statutory rights to interest and recovery costs on overdue business debts where applicable.

8. Cancellation and postponement

Cancellation and postponement requests must be made in writing. Any project specific cancellation schedule must be provided and agreed before the booking becomes binding.

Unless a different cancellation arrangement has been agreed, charges will reflect work already completed, reasonable costs committed to the booking that cannot be recovered, and demonstrable net loss arising from the cancellation. We will take reasonable steps to reduce that loss and account for costs saved, sums recovered and payments already made. We will not recover the same loss twice.

Postponements are subject to availability and may involve additional costs. We will confirm the revised arrangements in writing. If we cannot agree revised dates, the original booking will be treated as cancelled under this section.

9. Crew hours and additional costs

Crew working hours, overtime rates, travel, accommodation, expenses and any minimum booking periods will be set out in the quotation or otherwise agreed in writing.

Additional time or costs arising from client requested changes, delayed access or circumstances within the client’s control may be charged at the agreed rates. We will notify the client as soon as reasonably practicable and keep an appropriate record of additional time and costs.

10. Venue access and safe working

The client must provide accurate project information and arrange the access, permissions, facilities and venue readiness allocated to them in the agreed specification. This includes information about relevant site restrictions and known hazards.

Responsibilities for power supplies, rigging points, structural approvals and other technical facilities will be agreed for each project. Clients must not move or alter our installations or equipment without authorisation.

We may stop or decline work where we reasonably consider conditions unsafe. We will explain the concern promptly and work with the client to agree a safe way forward. Any resulting costs will be assessed according to the cause of the issue and the agreed contract.

11. Equipment ownership and use

Hired equipment remains the property of 808 Create Limited or the relevant supplying owner. Hire does not transfer ownership.

Equipment includes the accessories supplied with it, such as cables, connectors, cases and control equipment.

Where equipment is entrusted to the client, it must be kept secure, used only for its intended purpose and operated by competent people in accordance with supplied instructions. It must not be overloaded, altered, repaired, sold, lent or hired onwards without our prior written permission.

Equipment must not be taken outside Great Britain without our prior written permission and agreement of any additional insurance or transport arrangements.

12. Equipment responsibility and insurance

For equipment supplied without our operating crew, the client is responsible for its custody from the agreed handover until its return to us or collection by us. Delivery, collection and transport responsibilities will be confirmed in writing.

The client must maintain appropriate insurance for loss, theft and accidental damage during this period, including transit where they are responsible for it. Required insured values and any additional cover will be identified before the booking is confirmed. Evidence of cover may be requested before release of the equipment.

For equipment supplied with our crew, responsibility for custody, operation and insurance will be stated in the booking documents. The client is not responsible under this section for damage caused by our negligence, an existing defect or fair wear and tear.

13. Loss, damage and return

Equipment must be returned at the agreed time and place, with all supplied accessories and in the condition received, allowing for fair wear and tear.

The client must promptly report missing items, theft, damage or any incident involving equipment that causes injury or property damage. Suspected theft must also be reported to the police.

Where loss or damage falls within the client’s agreed responsibility, we may charge reasonable repair costs or, where repair is not practicable, reasonable replacement costs reflecting the equipment’s age and condition. Any insurance proceeds or other recovery will be taken into account.

Late returns may incur additional hire charges at the extension rate agreed before booking, for the actual additional period. We will not recover the same loss twice. Returning equipment early does not automatically reduce the agreed hire charge.

14. Equipment faults and substitutions

The client must notify us promptly of faults and stop using equipment that may be unsafe. Unauthorised repairs must not be attempted.

Where supplied equipment develops a fault for which we are responsible, we will take reasonable steps to repair or replace it promptly. If we cannot provide the affected supply, we will agree an appropriate reduction or refund for that part of the booking, without restricting any rights or remedies that cannot lawfully be excluded.

If specified equipment becomes unavailable, we may propose a suitable equivalent. Any substitution that materially affects the agreed specification or intended use requires the client’s agreement.

15. Designs and website content

Website text, images, graphics and branding belong to us or their respective owners. You may view the content and print or download reasonable extracts for your own reference. Commercial reproduction or reuse requires permission from the relevant rights holder.

Unless otherwise agreed in writing, we retain ownership of our original designs, drawings, programming files and other creative materials. On payment of the agreed fees, the client receives permission to use the supplied deliverables for the project and purposes described in the booking. Any wider use, transfer or supply of editable source files must be agreed separately.

16. External links, availability and security

Links to other websites are provided for convenience. We do not control their content or accept responsibility for their operation. A link does not imply endorsement.

We may update, suspend or withdraw website content. We do not guarantee uninterrupted availability or that the website will be free from all errors or harmful software. You should use appropriate security measures when accessing websites.

17. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.

Subject to the above, for business contracts we do not accept liability for indirect or consequential losses. Any additional exclusions or financial limits must be expressly agreed in the booking documents and remain subject to applicable law.

We do not exclude responsibility for our failure to use reasonable care and skill merely because equipment or a service involves third party suppliers.

18. Events outside our reasonable control

If an event outside a party’s reasonable control prevents performance, the affected party must promptly notify the other, explain the likely impact and take reasonable steps to reduce disruption.

The parties will seek to agree revised arrangements. If the affected services cannot reasonably proceed or be rescheduled, either party may cancel the affected part of the booking. Charges will be limited to services already delivered and reasonable, unavoidable costs properly committed to that part of the booking, after accounting for savings, recoveries and sums already paid. Any excess advance payment will be refunded.

19. Privacy and cookies

Information about our handling of personal data and our use of cookies is set out in our separate Privacy Policy and Cookie Policy. These terms do not themselves provide consent to optional cookies or marketing.

20. Changes to these terms

We may update these terms and will show the revised date on this page. Updated website provisions apply to future website use. Changes do not retrospectively alter existing bookings unless both parties agree in writing.

21. Governing law and disputes

These terms are governed by the law of England and Wales. For business contracts, the courts of England and Wales have exclusive jurisdiction.

This does not restrict any mandatory rights a consumer may have to bring proceedings in another court.
